1. Acceptance of Terms

By visiting our website, placing an order on our Shopify store, or purchasing through our Etsy shop, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or place an order.

These terms apply to all purchases made directly from AuDHDly, LLC. Orders placed through Etsy are additionally governed by Etsy's Terms of Use. In the event of a conflict between these terms and Etsy's platform policies for an Etsy transaction, Etsy's policies govern.

By using our website or placing an order, you represent that you are at least 18 years of age, or the applicable age of majority in your jurisdiction, and that you have the legal capacity to enter into a binding agreement.

2. About AuDHDly, LLC

AuDHDly, LLC is a limited liability company registered in the Commonwealth of Virginia, USA. We design, assemble, and sell the Peek-a-Hide reptile monitoring hide and related products.

3. Products & Product Descriptions

Accuracy of Descriptions

We make every effort to accurately describe our products, including dimensions, materials, and included components. However, product details are subject to change without notice as we improve our designs. Colors displayed on screen may differ from the physical product due to display settings and filament batch variation.

3D Printed Products

Peek-a-Hide units are individually 3D-printed. As a result, minor surface variations — such as faint layer lines, slight texture differences, or minor color variation between batches — are a normal and expected characteristic of the manufacturing process. These variations are not defects. We reserve the right to substitute comparable components or materials of equal or greater quality when necessary.

Availability

All products are subject to availability. We reserve the right to discontinue any product, limit quantities, or refuse an order at any time.

4. Intellectual Property & Software License

Proprietary Software

Each Peek-a-Hide unit includes a preloaded microSD card containing AuDHDly, LLC's proprietary software. This software is licensed to you, not sold. Your purchase grants you a limited, non-exclusive, non-transferable license to use the software solely on the Peek-a-Hide unit it was shipped with, for personal, non-commercial purposes.

You may not:

  • Copy, reproduce, or redistribute the software or its contents
  • Reverse engineer, decompile, or disassemble the software
  • Modify, adapt, or create derivative works based on the software
  • Transfer the software license to another person or device (except as part of a resale of the complete, unmodified unit)
  • Use the software for commercial purposes without written permission from AuDHDly, LLC

If you resell the complete, unmodified unit, the software license transfers to the new owner and your license terminates at the time of transfer.

Open Source Software

The Peek-a-Hide runs on open-source software. AuDHDly, LLC's proprietary software operates on top of these components, which are distributed under their respective licenses:

  • Linux kernel / Raspberry Pi OS — GNU General Public License v2 (GPL v2)
  • NetworkManager — GNU General Public License v2 (GPL v2)
  • Avahi (mDNS/.local hostname resolution) — GNU Lesser General Public License v2.1 (LGPL v2.1)
  • rpicam-apps (camera capture) — BSD 2-Clause License
  • MediaMTX (video streaming) — MIT License
  • Flask (api server) — BSD 3-Clause License
  • Python — Python Software Foundation License (PSF)

AuDHDly, LLC does not modify the source code of any GPL-licensed components. Source code for GPL-licensed components used in this product is publicly available through their respective upstream project repositories (e.g., github.com/raspberrypi for Raspberry Pi OS). AuDHDly, LLC's proprietary software runs as an independent application layer and does not incorporate GPL-licensed code. Use of this product does not grant you any rights to AuDHDly, LLC's proprietary software beyond the license described above.

Website & Brand Content

All website content, product names, logos, images, and descriptions are the intellectual property of AuDHDly, LLC and may not be reproduced, distributed, or used without prior written permission.

5. Orders & Payment

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. If we decline your order after payment has been processed, we will issue a full refund.

Pricing

All prices are listed in US dollars (USD). We reserve the right to change prices at any time without notice. The price at the time your order is placed is the price you will be charged.

Payment

Payment is processed securely through Shopify Payments or Etsy Payments (depending on the platform used). AuDHDly, LLC does not store your full payment card information. By completing a purchase, you represent that you are authorized to use the payment method provided.

Taxes

Applicable sales tax may be collected depending on your shipping address and applicable tax laws.

6. Shipping & Delivery

We ship within the United States only. Estimated shipping times are provided at checkout and are estimates only — we are not responsible for carrier delays. Title and risk of loss transfer to the buyer upon handoff to the shipping carrier.

If a package is lost or damaged in transit, please contact us and we will work with you to file a claim with the carrier.

7. Returns, Refunds & Warranty

Our return and refund terms are detailed in our Return & Refund Policy. Hardware warranty terms are detailed in our Warranty & Liability Policy. Both policies are incorporated into these Terms of Service by reference.

8. Limitation of Liability

To the fullest extent permitted by applicable law, AuDHDly, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services. Our total liability for any claim shall not exceed the purchase price paid by you for the product giving rise to the claim.

We make no warranties regarding the fitness of our products for any particular purpose beyond what is expressly stated in our product descriptions. Use of the Peek-a-Hidein a reptile enclosure is at the buyer's own risk, as described in our Warranty & Liability Policy.

9. User Conduct

You agree not to:

  • Use our website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of our website or systems
  • Submit false or fraudulent orders
  • Use the Peek-a-Hide or its software in any manner that violates applicable law, including laws regarding recording, surveillance, or privacy

10. Remote Support Services

AuDHDly, LLC may offer remote technical support for your Peek-a-Hide device using Raspberry Pi Connect, Raspberry Pi Ltd.'s official remote desktop access service.

  • Remote support is entirely optional and will only occur with your explicit, active consent.
  • We will never connect to your device without your authorization.
  • We cannot access your camera stream during a remote session under any circumstances.
  • You can terminate an active remote session at any time by powering off your device.

11. Cloud Services

The one-time Wi-Fi setup process for the Peek-a-Hide relies on a third-party cloud service (Google Firebase) so that the setup page can confirm when your device has successfully joined your home Wi-Fi network. After setup, the device operates locally on your home network and does not depend on this service for normal use.

Because this feature depends on a third party, we cannot guarantee uninterrupted availability of the cloud setup service. If the service is temporarily unavailable, you may need to retry Wi-Fi setup at a later time. See our Privacy Policy for details on what data is shared with Firebase during this process.

12. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these terms or your purchase from AuDHDly, LLC shall first be attempted to be resolved informally by contacting us at audhdlyreptilestudio@gmail.com. If informal resolution fails within 30 days, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts of competent jurisdiction located in Virginia, and you irrevocably consent to the personal jurisdiction and venue of such courts.

13. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.

14. General Provisions

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Warranty & Liability Policy, and Return & Refund Policy, constitute the entire agreement between you and AuDHDly, LLC regarding your use of our website and purchase of our products, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

No Waiver

Our failure to enforce any right or provision of these Terms of Service will not be considered a waiver of that right or provision.
